These Terms and Conditions (“Terms”) govern your access to and use of the website located at restorian.co (the “Site”) and any services provided by Restorian LLC (“Restorian,” “we,” “us,” or “our”). By accessing the Site or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or our services.

Restorian provides property damage restoration services, including water damage restoration, flood damage cleanup, fire damage restoration, smoke and odor removal, mold remediation, biohazard cleanup, storm and disaster services, commercial restoration, and reconstruction services throughout New Jersey, New York, and Connecticut.

2. Acceptance of Terms

By using our Site or requesting our services, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms and all applicable laws and regulations.

3. Use of the Site

You agree to use the Site for lawful purposes only. You agree not to:

• Use the Site in any manner that could disable, overburden, damage, or impair the Site
• Use any automated system, including robots, spiders, or scrapers, to access the Site
• Attempt to gain unauthorized access to any portion of the Site or any connected systems

Emergency response times described on the Site are estimates based on typical operating conditions. Actual response times may vary based on call volume, weather, road conditions, geographic location within our service area, and other factors outside of our control.

5. Service Agreements

All restoration services performed by Restorian are subject to a separate written service agreement, work authorization, or scope of work document signed by the property owner or authorized representative before work begins. These Terms do not replace or modify any such service agreement. In the event of a conflict between these Terms and a signed service agreement, the signed service agreement controls for matters related to that specific project.

6. Payment and Insurance

Restorian accepts payment directly from property owners and from insurance carriers on approved claims. Restorian is Xactimate certified for insurance documentation and works with major carriers including NJM Insurance Group, State Farm, USAA, Allstate, AIG, Progressive, American Family Insurance, Nationwide, Liberty Mutual, and Farmers Insurance. Coverage, policy limits, deductibles, and claim approvals are determined solely by your insurance carrier, not by Restorian. Any portion of the work not covered by insurance is the responsibility of the property owner.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, photographs, videos, and software, is the property of Restorian LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works from any content on the Site without prior written permission from Restorian.

The Restorian name, logo, and tagline “Renew. Rebuild. Restore.” are trademarks of Restorian LLC.

8. Third Party Links

The Site may contain links to third party websites, including insurance carrier sites, industry organization sites, and social media platforms. These links are provided for convenience only. Restorian does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third party website. Your use of any third party site is at your own risk.

9. Disclaimers

The Site and all content on it are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Restorian, its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the Site, even if Restorian has been advised of the possibility of such damages.

In no event shall Restorian’s total liability for any claim arising out of or related to the use of the Site exceed one hundred dollars ($100.00). This limitation does not apply to liability that cannot be excluded or limited under applicable law.

This limitation applies to the Site only. Liability related to restoration services performed by Restorian is governed by the separate written service agreement for that project.

11. Indemnification

You agree to indemnify, defend, and hold harmless Restorian LLC and its owners, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Bergen County, New Jersey, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

Restorian reserves the right to modify these Terms at any time. Updated Terms will be posted on the Site with a revised “Last Updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. Please review these Terms periodically.

14. Severability
